Summary

In unincorporated Orange County, contractors working under a right-of-way utilization permit who block a sidewalk or bike lane must apply the same traffic-control measures required for closing a vehicle travel lane.

City-specific rules exist: Orlando has its own obstruction rules rules that differ from Orange County's county-level regulations. If you live in Orlando, check the city-specific page instead.

The blockage of a sidewalk, bicycle lane, or other public bicycle path shall be treated in the same manner as the closure of a lane of motor vehicle traffic by applying similar temporary traffic control practices as would be applied to the closure of a lane of motor vehicle traffic for each permit issued.(d)When an open cut of a county road has been authorized, and a detour/diversion traffic route has not been requested or approved by the county engineer, no lane closure will be authorized prior to 9:00 a.m. or later than 3:00 p.m. without specific and individual approval. In the case of a two-way/two-lane road, one-lane traffic may be authorized during this period. In the case of a two-way/four-lane road, two-way/two-lane traffic will normally be required. All traffic control practices shall comply with the most recent edition of the Manual on Uniform Traffic Control Devices and/or all applicable Florida Department of Transportation Standard Plans.

Full Breakdown

Under the county's right-of-way utilization permit program, Sec. 21-236(c) requires that any blockage of a sidewalk, bicycle lane, or other public bicycle path be treated the same as closing a motor-vehicle traffic lane, with equivalent temporary traffic control. Permittees must submit a maintenance-of-traffic (MOT) plan to the Orange County Traffic Engineering Division and provide ADA-accessible pedestrian routing around the affected sidewalk under Sec. 21-236(e). Applies only in unincorporated Orange County, not inside Orlando or the county's other cities.

Violations & Fines

Violations of the right-of-way utilization article are punishable under Sec. 21-174 by up to a $500 fine or 60 days in jail per Sec. 1-9(c); the County Engineer may also revoke the permit for MOT noncompliance under Sec. 21-236(g).
