(2) Freestanding signs. ... Except as otherwise provided for herein, electronic message boards are permitted as freestanding signs in the B1, B2, B3, CI, LI and GI Zoning Districts. Temporary or portable electronic message boards are not permitted. Electronic message boards shall not exceed 60 square feet in size, and shall display only on-premises messages, or time and/or temperature displays. An electronic message board shall consist only of alphabetic or numeric characters and shall not include any graphic, pictorial or photographic images or videos. The appearance of any animation, motion, flashing, blinking or shimmering is not permitted. A single message, or segment of a message, shall have a display time of at least 2 seconds ... with all segments of the total message to be displayed within 10 seconds. A display traveling horizontally across the message board shall move between 16 and 32 light columns per second.

Code of Harford County § 267-33B(2) governs digital signage countywide. Electronic message boards are permitted only as freestanding signs in the B1, B2, B3, CI, LI and GI Zoning Districts, capped at 60 square feet, and the code is explicit that they "shall display only on-premises messages, or time and/or temperature displays," which rules out off-premises digital advertising, the very thing a digital billboard sells. Section 267-33B(3) applies the same on-premises-only, 20-square-foot cap to electronic message boards used as wall signs in the same districts, and § 267-33B(9) limits any property to one electronic message board of any permitted type. Layered on top, § 267-33F(6) prohibits "variable message boards" outright in every zoning district, a separate defined sign type covering electronic or mechanical displays that change other than through the narrowly permitted electronic message board format.

Because true off-premises billboards under § 267-33B(7) are confined to the GI District and electronic message boards are restricted to on-premises content, a digital, off-site advertising billboard has no path to legal approval anywhere in unincorporated Harford County.

Violations & Fines

Signs that violate the digital-display rules, whether by showing off-premises advertising on an electronic message board, running animation or video, or operating as a prohibited variable message board, are subject to removal by the Director of Planning under § 267-33G(3). The owner receives written notice to remove the sign or bring it into compliance within 10 calendar days; if the owner fails to act, or the sign poses an immediate safety threat, the Department may remove it without further notice and bill the removal cost to the property owner, which becomes a lien collectible like ordinary taxes.
