Unincorporated San Benito County bans new billboards outright and prohibits converting existing legal billboards to animated or digital displays; only electronic time-and-temperature signs are allowed as part of an on-site sign.

These county ordinances apply to unincorporated areas of San Benito County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

The construction, erection or use of any and all billboards as defined herein, other than those which legally exist in the county, or for which a valid permit has been issued and has not expired, as of the date on which this provision, or when a prior version of this article containing a provision to the same effect, was adopted, is prohibited. The “change of copy” provision applies to properly permitted, legally existing billboards. To the extent consistent with state law, existing legal billboards may not be converted to a more visually intense method of image presentation, such as converting a flat static display to a moving animated or change image display. This prohibition does not prohibit or limit agreements to relocate presently existing legal billboards, as encouraged by state law including, but not limited to, Cal. Business and Professions Code § 5412.

Full Breakdown

The county's sign article bars construction of any new billboard in unincorporated San Benito County, exempting only billboards that already legally existed or held an unexpired permit when the rule was adopted (§ 25.07.016(C)(5)). Even those grandfathered billboards cannot be converted to a more visually intense format, such as swapping a flat static face for a moving, animated, or change-of-image display. Separately, permanent structure signs anywhere in the county that rotate, present moving images, flash, scintillate, or use animated illumination are prohibited outright (§ 25.07.016(K)(3)). The only electronic-display carve-out is a time-and-temperature sign attached to an already-allowed on-site sign (§ 25.07.016(L)(1)).

Violations & Fines

Erecting a new billboard, converting an existing legal billboard to a moving or digital display, or installing any rotating, flashing, or scintillating sign is a zoning code violation subject to county code enforcement and required removal.
