Summary

Sussex County lets off-premises digital billboards operate only by special use exception in select commercial and industrial districts, with a 10-second minimum hold per message, a one-second transition, and no scrolling, video or animation under § 115-161.1B.

These county ordinances apply to unincorporated areas of Sussex County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Off-premises electronic message centers: (1) In the C-1 (General Commercial), CR-1 (Commercial Residential), C-3 (Heavy Commercial), C-4 (Planned Commercial), C-5 (Service/Limited Manufacturing), LI-1 (Limited Industrial), LI-2 (Light Industrial) and HI-1 (Heavy Industrial) Districts, an off-premises sign may be an electronic message center, provided that the owner obtains a special use exception pursuant to § 115-80C and complies with the regulations for off-premises signs pursuant to § 115-159.5.

Full Breakdown

1, added October 11, 2016 by Ordinance No. 2470, regulates off-premises electronic message centers (digital billboards) separately from on-premises electronic signs. 5. They are flatly prohibited in every agricultural and residential district under B(2). Spacing is stricter than for static billboards: on roads with fewer than four travel lanes, digital billboards must sit at least 1,200 feet apart; on roads with four or more lanes, 2,500 feet, both measured edge to edge on the same side of the road, per B(3)-(4). Content rules under B(5) and C bar animation, flashing, streaming or real-time video, fading, dissolving, scrolling, spinning and rotating effects.

Each message must remain fixed for at least 10 seconds, and any change between messages must complete in one second or less with all elements changing simultaneously, per C(1)(a)-(b). Every digital billboard must include a default fail-safe that freezes, shuts down, or shows a black screen if a malfunction affects at least half the sign face, per C(1)(c), and must auto-dim via photocell, hardwire or software as ambient light changes, per C(1)(e)-(f). No audio or verbal announcements are permitted under C(1)(h), and no variance from any electronic message center regulation is allowed under C(2).

Violations & Fines

Operating an off-premises digital billboard without a § 115-80C special use exception, inside a prohibited residential or agricultural district, closer than the required 1,200- or 2,500-foot spacing, or using banned effects like scrolling or video violates § 115-161.1B-C. Because § 115-161.1C(2) bars any variance, noncompliant digital billboards face removal and the § 115-160M penalty: a mandatory minimum $100 fine (up to $1,000) or up to 10 days' imprisonment, with each day a separate offense.
