Political signs are strongly protected here. Election Code 259.003 bars Seguin, Schertz, and Cibolo from banning, charging for, or size-limiting a political sign on consenting private property, and 259.002 stops an HOA from removing yard signs near an election.
A property owner may post political signs on their own land with no county permit; unincorporated Guadalupe County has no sign ordinance at all. Inside the cities, Section 259.003 bars a sign ordinance from prohibiting, permitting, or restricting the size of a sign carrying a primarily political message on private property with the owner's consent, and content-based sign rules are unconstitutional after Reed v. Town of Gilbert (2015). In deed-restricted subdivisions, Election Code 259.002 and Property Code 202.009 stop an HOA from banning candidate or measure signs from the 90th day before an election through the 10th day after, though the HOA may require ground-mounting, one sign per race, and a size no larger than four by six feet.
A political sign placed in a public road right-of-way violates Transportation Code 393.002 and can be removed. Signs larger than four feet by six feet fall outside the HOA protection in Section 259.002.
