Texas Property Code Section 202.010 prevents any Guadalupe County homeowners' association from enforcing a deed restriction that prohibits or restricts a solar energy device. Associations in newer master-planned communities around Schertz, Cibolo, and Seguin may regulate placement - for example requiring panels to conform to the roofline or slope - but only where doing so does not reduce the device's estimated energy production by more than ten percent. An association may not withhold approval unless the proposed placement substantially interferes with a neighbor's use and enjoyment of their land. This is a strong statewide protection, so an HOA cannot simply refuse solar on aesthetic grounds.
An HOA that denies or fines a compliant solar installation is enforcing a void provision. The homeowner can seek relief through the courts, and the association risks paying the owner's attorney's fees.
