City-specific rules exist: Miami, Doral, Homestead, Hialeah, and Coral Gables have their own panel permits rules that differ from Miami-Dade County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Full Breakdown

Miami-Dade County Code § 33-20(o) makes a solar energy system a permitted accessory structure and ancillary use in every zoning district of unincorporated Miami-Dade (UMSA), so no unusual-use hearing is required. A roof-mounted array follows the front setback of the principal building; a ground-mounted array must also meet the district's accessory-building side and rear setbacks. Homeowners still need a standard building permit from the County's Building Department under the Florida Building Code for the structural and electrical work, and any solar hardware exempt from that code instead needs a zoning improvement permit under § 33-8.1 before installation. Floating panel systems on ponds fall under a separate subsection.

Violations & Fines

Skipping the required permit for a solar installation violates Chapter 33 and, under § 33-39, carries up to a $500 fine or 60 days in jail per day of noncompliance, plus Chapter 8CC civil fines.

Frequently Asked Questions

Do I need a permit for rooftop solar panels in unincorporated Miami-Dade?
Yes. Solar panels are a permitted accessory use, but you still need a standard building permit under the Florida Building Code for the structural and electrical work, or a zoning improvement permit if the equipment is code-exempt.
Does this rule apply inside Miami, Hialeah, or Miami Beach?
No. § 33-20 is part of the County zoning code, which by its own terms governs only unincorporated Miami-Dade (UMSA); each of the 34 cities sets its own solar permitting rules.
