AB 2188 codified at Government Code 65850.5 requires every city and county, including Santa Clara County, to adopt an expedited permitting ordinance for residential rooftop solar up to 10 kW AC or 38.4 kW thermal. The county Building Permit Center accepts online applications, and complete submittals must receive a permit within 3 business days and a single inspection. Permit fees are capped by AB 1414 at 450 dollars plus 15 dollars per kW above 15 kW for residential, and 1000 dollars plus 7 dollars per kW above 50 kW for commercial. California Title 24 Part 6 Section 150.1(c)(14) requires most new single-family and low-rise multifamily homes to include a solar PV system sized to offset annual electricity use, with exceptions for heavily shaded lots. Battery storage systems paired with PV follow Cal Fire defensible space rules and NFPA 855. Interconnection with PG and E is handled through Rule 21 and NEM 3.0 (Net Billing Tariff) effective April 15 2023, which values exported energy at the Avoided Cost Calculator rate rather than full retail. Battery storage is strongly incentivized under NEM 3.0. Self-generation incentive program rebates for batteries are administered by CPUC. Santa Clara County unincorporated solar projects must also meet Wildland Urban Interface roof rapid shutdown requirements under CEC 690.12.
