(e)Uninvited soliciting prohibited. Full Breakdown
Section 15-8 regulates residential soliciting and peddling countywide, in the unincorporated area only (15-8(i)). Before knocking or ringing a bell to "attract the attention of an occupant," a solicitor has a duty under 15-8(b) to first check whether a "nonsolicitation notice" is posted near the main entrance. Section 15-8(a)(3) defines a valid notice as any legible sign reading "No Solicitors," "No Soliciting," "No Peddlers," "Solicitation Prohibited" or similar wording. If such a sign is posted, 15-8(c) and (e) require the solicitor to immediately and peacefully leave without attempting to attract an occupant's attention; entering anyway is a violation.
Section 15-8(d) also requires a solicitor to leave immediately once any occupant asks them to, regardless of a sign. 117, Florida Statutes. Violations of the sign-defiance rule (e) or the hours rule (f) are category 1 civil infractions ($25) under 15-20(j), enforceable as a nonexclusive alternative to prosecution, with the category enhanced for repeat violations under 15-20(k). 69, Florida Statutes, punishable by up to a $500 fine and 60 days in the county jail, per 15-8(g).
Violations & Fines
Soliciting past a posted "No Solicitors" sign or outside the 9:00 a.m. to 9:00 p.m. weekday window is a category 1 civil infraction, $25 for an initial violation, escalating for repeats under section 15-20(k), or prosecutable as a second-degree misdemeanor up to $500 and 60 days in jail for habitual offenders.
