Summary

Anyone soliciting door-to-door in unincorporated St. Clair County must register annually with the County Clerk before knocking on a single door. County Code Section 8-1-3 requires a written application in advance of any solicitation, and Section 8-1-4 spells out what that application must contain, including a physical description and fingerprints if the Sheriff asks for them.

These county ordinances apply to unincorporated areas of St. Clair County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

8-1-3 REGISTRATION REQUIRED. Every person desiring to engage in solicitation as herein defined, within residences in this County, is hereby required to annually make written application for a certificate of registration prior to any solicitation, as hereinafter provided, with the exception noted in Section 8-1-1, relative to those charitable or non-profit groups, clubs, associations or projects. 8-1-4 APPLICATION FOR CERTIFICATE OF REGISTRATION. Application for a Certificate of Registration shall be made upon a form provided by the County Clerk of this County... The form shall include name, age, address, marital status, physical description, name of employer, nature of product or services and proposed method of operation within the County, in addition to any other information deemed necessary by the Sheriff, including fingerprinting. 8-1-10 FEE REQUIRED. Each approved registered solicitor shall pay to the County Clerk a daily fee of Ten Dollars ($10.00), or an annual fee of Fifty Dollars ($50.00); the fee being personable, not transferable, and not refundable.

Full Breakdown

The application goes to the County Clerk's office on a county-supplied form and must truthfully state the applicant's name, age, address, marital status, physical description, employer, the product or service offered, and the proposed method of operating in the county, plus anything else the Sheriff wants, including fingerprinting (Sec. 8-1-4). The Clerk keeps a complete record of every application, including any denials. Under Section 8-1-5 the Clerk may forward the file to the Sheriff, who investigates the applicant's business character and reports back within 10 days; the Clerk can then issue a registration card or deny the application.

A certificate can be revoked if the holder is convicted of violating this chapter, any other county ordinance, or state or federal law, or made a false statement on the application; revocation is effective the day the Clerk mails the notice by certified or registered mail. Every certificate expires January 1 regardless of issue date (Sec. 8-1-6). Charitable and non-profit solicitors, census takers and church surveyors are exempt from registration and the fee if pre-authorized in writing by the Clerk, but they still must carry that letter and follow the Section 8-1-9 hours limit.

Residents under 16 are exempt from the fee requirement too. Solicitors working inside a municipality like Belleville or O'Fallon are exempt from this county article entirely under Section 8-1-11, since the municipality's own ordinance governs there.

Violations & Fines

Soliciting without a valid certificate, or violating any condition attached to one, gives the County Clerk grounds to revoke it under Section 8-1-5, effective the day revocation notice is mailed. Section 8-1-7 requires a registered solicitor to produce the certificate card on request and to leave immediately if an occupant asks; soliciting for anything beyond what the application listed also breaches that section.

Frequently Asked Questions

Do I need a permit to sell door-to-door in unincorporated St. Clair County?
Yes. Section 8-1-3 requires written application for a certificate of registration before any solicitation begins, filed with the County Clerk's office in advance every year.
How much does registration cost?
Section 8-1-10 sets the fee at $10 per day or $50 for an annual certificate. The fee is personal, not transferable between people, and not refundable once paid, regardless of how long the certificate is actually used.
Can the County deny or revoke my registration?
Yes. The Clerk can deny an application after the Sheriff's background check, and can revoke an issued certificate under Section 8-1-5 if the holder is convicted of violating county, state or federal law, or lied on the application.
