Port St. Lucie regulates aggressive panhandling and roadside solicitation. Passive panhandling is First Amendment protected, but aggressive conduct, roadway solicitation, and obstruction of traffic are prohibited.
Following Reed v. Town of Gilbert (2015) and subsequent federal rulings, content-based panhandling bans are unconstitutional. PSL enforces content-neutral restrictions: prohibiting solicitation in roadways and medians due to traffic safety; prohibiting aggressive panhandling defined as intimidation, following, touching, or blocking; restricting solicitation near ATMs, bus stops, outdoor dining areas, and after dark. Roadway solicitation from median strips is a consistent enforcement priority on US-1, Port St. Lucie Boulevard, and St. Lucie West Boulevard due to pedestrian fatality risk. Homeless individuals receive referrals to Treasure Coast Homeless Services Council and other outreach programs rather than prosecution when possible. Giving from a vehicle to a median solicitor is also a traffic offense for impeding flow.
Aggressive panhandling: $100-$500 fine, possible misdemeanor. Roadway solicitation: $50-$150 fine, traffic infraction. Repeat offenders may receive trespass warnings for specific properties.
