Summary
Whatcom County requires a county permit before anyone hosts an outdoor musical entertainment, amusement or assembly expected to draw 2,000 or more people, run five hours or longer, and charge admission, under WCC 5.40.010 and Chapter 70.108 RCW. The promoter must also post a cash deposit or surety bond, provide parking for one vehicle per four attendees, and end the event by midnight.
It is unlawful for any person, persons, organization, landowner, or lessor to allow, encourage, organize, promote, conduct, permit or cause to be advertised an entertainment, amusement, or assembly of persons wherein one of the primary purposes will be the presentation of outdoor, live, or recorded musical entertainment, which said person, persons, or corporation, organization, landowner or lessor believes or has reason to believe will attract 2,000 or more persons, where the duration of the program is five hours or longer, and where a charge or contribution is required for admission, unless a valid county permit has been obtained for the operation of the assembly pursuant to Chapter 70.108 RCW, Outdoor Music Festivals.

Violations & Fines
Section 5.40.060 makes it a misdemeanor to violate any provision of Chapter 5.40, to willfully fail to keep complying with a permit's terms and conditions once issued, or to counsel, aid or abet such a violation. The Whatcom County sheriff also has standing authority under Section 5.40.030 to order a promoter to limit further admissions once attendance exceeds the represented crowd size by 20 percent, and a promoter who ignores that order is separately exposed to the chapter's misdemeanor penalty.
