A limited use permit is required for temporary special events. Non-profit and/or charitable organizations shall only be required to submit an information sheet, on a form to be approved by the Department, that identifies the nonprofit or charitable organization and the name, address and telephone number for a primary contact. This activity is limited to no more than six (6) times per year, and each event shall last no longer than fourteen (14) days.
Official source re-checked September 7, 2026: no newer edition of the code had been published (publisher’s edition: Code of Ordinances: Supplement 5).
Full Breakdown
New Castle County's Unified Development Code treats outdoor concerts, carnivals, circuses, religious gatherings and similar "special events" as a temporary land use requiring a limited use permit from the Department of Land Use before the event happens on private or commercial property. Nonprofit and charitable groups skip the full application and instead file an information sheet naming a contact person. Any one property can host no more than six such events a year, each capped at 14 days, and no display, sales or parking is allowed in a street right-of-way. This UDC chapter governs unincorporated New Castle County only; Wilmington and Newark run their own municipal codes and are not covered here.
Violations & Fines
Holding a special event without the limited use permit, or exceeding the six-event/14-day cap, is a zoning violation; the County's general penalty starts at a $100 fine for a first offense, rising for repeat violations within 12 months.
