Sahuarita Special Events & Permits: Sidewalk Cafe Rules Rules (2026)

Restaurants and food service establishments in Sahuarita's commercial zones may operate sidewalk cafe seating with approval from the Town. An encroachment permit or right-of-way use agreement is required when tables, chairs, planters, or barriers extend onto public sidewalks or rights-of-way. The permit application requires a site plan showing the proposed seating layout, the width of remaining pedestrian clearance (minimum 48 inches for ADA compliance), furniture specifications, and hours of operation. The establishment must maintain the sidewalk area in clean and safe condition, remove all furniture during non-operating hours unless otherwise approved, and carry liability insurance covering the sidewalk area. Alcohol service in outdoor seating areas requires that the establishment's Arizona liquor license includes the patio or sidewalk extension on its licensed premises diagram. Sahuarita's desert climate makes outdoor dining popular during the cooler months from October through April, and many establishments along Sahuarita Road and the Rancho Sahuarita commercial area have incorporated permanent patio dining into their designs. Businesses operating in shopping centers may also need landlord approval. The Town does not charge an annual sidewalk cafe fee for standard configurations.
