Summary

Citrus County's Land Development Code regulates outdoor dining only within an approved Town Center Plan Overlay, a planned-unit-development option for unincorporated commercial nodes. Restaurants may set out only tables, chairs and umbrellas, must secure or store them indoors after hours, must supply an outdoor refuse container, and cannot block the sidewalk. There is no separate county sidewalk-cafe permit outside this overlay, and it never reaches Crystal River or Inverness.

These county ordinances apply to unincorporated areas of Citrus County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

H. Outdoor Dining

1. Outdoor furnishings are limited to tables, chairs and umbrellas. Such furnishings must be securely fastened as permanent amenities, or otherwise stored inside the restaurant after normal operating hours.

2. Planters, posts with ropes, or other removable enclosures are encouraged and shall be used as a way of defining the area occupied by the café or outdoor restaurant seating area.

3. The establishment shall provide refuse facilities within the outdoor dining area.

4. Outdoor dining shall not impede pedestrian traffic flow.

5. Development with use of Leadership in Energy and Environmental Design (LEED) and other sustainable design principles is encouraged.

Full Breakdown

LDC Section 3405(H), Outdoor Dining, within Chapter Three's Town Center Plan Overlay standards, limits outdoor furnishings to tables, chairs and umbrellas, which must be permanently secured or stored inside after normal operating hours. Planters, posts with ropes, or other removable enclosures are encouraged to mark off the dining footprint, and every outdoor dining area must have its own refuse facility so trash does not migrate to adjacent sidewalks. Outdoor dining cannot impede pedestrian traffic flow, and the LDC separately encourages, without requiring, LEED and other sustainable design elements.

Outdoor dining is also listed as a permitted use in Section 3403(A)(18) of the same overlay. Critically, none of this is a standalone sidewalk-cafe license: the overlay itself only exists where a property owner has applied for a Town Center Plan under Section 3400, reviewed by the county's Planning and Development Commission and approved by the Board of County Commissioners at a noticed public hearing, with density and intensity tied to the underlying Comprehensive Plan designation. A restaurant elsewhere in unincorporated Citrus County, or inside the separately coded cities of Crystal River and Inverness, is not covered by this section. The chapter text is current through Ordinance 2026-A16, adopted June 22, 2026.

Violations & Fines

Under LDC Section 1800(D), an outdoor dining setup that violates these standards can be referred to the Citrus County Code Compliance Special Master under Florida Statutes Chapter 162 and Chapter 19 of the County Code, or cited directly under that same authority. The county may also withhold or revoke development approvals and permits on the property until the violation is corrected, and can pursue a civil injunction to force compliance or restore the site.

Frequently Asked Questions

Does Citrus County issue a standalone sidewalk-cafe permit?
No. Outdoor dining is a listed use and design standard inside an approved Town Center Plan Overlay, a Planned Unit Development track under LDC Section 3400 that requires Planning and Development Commission review and Board of County Commissioners approval at public hearing. There is no separate sidewalk-cafe license for restaurants outside that overlay.
What furnishings can a restaurant put outside under this rule?
LDC Section 3405(H)(1) limits outdoor furnishings to tables, chairs and umbrellas, and they must either be permanently secured in place or brought inside after normal operating hours. Planters, posts with ropes, or similar removable enclosures are encouraged to define the seating area but are not required.
What if a restaurant's outdoor dining blocks the sidewalk?
LDC Section 3405(H)(4) directly bars outdoor dining from impeding pedestrian traffic flow. A violation can be referred to the Code Compliance Special Master under Florida Statutes Chapter 162 and Chapter 19 of the County Code, cited, or used as grounds to withhold future permits under LDC Section 1800.
