Full Breakdown

Outdoor dining is allowed only as an accessory use to an indoor restaurant, not as a standalone food stand. If tables sit on a sidewalk, a minimum 5-foot-wide clear pedestrian path must remain open. Barriers or landscaping around the seating area can't exceed 3.5 feet high, and any barrier placed in the public right-of-way must be fully portable. Signage is limited to a menu sign; business names may appear only on awning or umbrella valences. Setting up in the right-of-way requires a right-of-way use permit from the agency with jurisdiction, and the Zoning Administrator or Town Chairperson can suspend that use without notice for public-safety, construction, or event needs. This applies only in towns that have adopted county zoning (Wis. Stat. § 59.69): it does not reach into Wausau or any incorporated village.

Violations & Fines

Zoning Administrator or Town Chairperson may suspend right-of-way dining use without prior notice; general ordinance violations draw a forfeiture under Chapter 25.04 plus prosecution costs, with each day a separate offense (§ 17.807).
