Full Breakdown

Article III, Outdoor Public Assemblies, applies to outdoor musical concerts, fairs, carnivals, mechanical amusement rides, and any tent over 200 square feet expected to draw 200 or more people at once, but exempts places of personal residence under § 10-58. Section 10-61 requires the sponsor, owner, agent or promoter to obtain a special event permit from the building inspection department and post it conspicuously at the site; the permit expires at the end of the function and cannot exceed 30 days, though the building official, with the sheriff's department's approval, may grant five-day extensions on written request.

Section 10-65 requires the sponsor to arrange at least two paid law enforcement officers for every 1,000 expected attendees, with funds escrowed with the county treasurer in advance (waived for religious, academic or tax-deductible charitable events), notify the emergency service department of the event's time and location, and keep an unobstructed path for emergency vehicles. Section 10-66 requires portable toilets, three per 1,000 male attendees and three per 1,000 female attendees, at least two if under 1,000 people, and makes the sponsor responsible for hauling all solid waste to the county landfill immediately after the event.

Section 10-64 bars tents within 50 feet of a public right-of-way and requires clearing combustible brush and grass near tents. where the site is out of residential hearing range. 00 each under § 10-62.

Violations & Fines

Violating any section of Article III is a misdemeanor under § 10-59, punishable by a fine of up to $200.00 or up to 30 days' imprisonment. The sheriff's department and the building official jointly enforce the article under § 10-60, and an uncorrected reinspection, whether from a wrong address, uncompleted repairs, or a site that is not ready, triggers a $15.00 charge for each additional inspection.

Frequently Asked Questions

Does a small neighborhood block party need a permit under this article?
No. Article III only reaches outdoor musical concerts, fairs, carnivals and mechanical-ride events expected to gather 200 or more people, plus tents larger than 200 square feet, and § 10-58 specifically exempts places of personal residence. A small backyard or driveway gathering below that size and outside those categories falls outside this permit requirement entirely.
How many portable toilets does a festival organizer have to provide?
Section 10-66 requires three portable toilets for every 1,000 expected male attendees and three for every 1,000 expected female attendees, with a two-toilet minimum for any event under 1,000 people. The sponsor must have them in place before the event opens and is responsible for removing all solid waste to the county landfill immediately afterward.
How close can a festival tent be set up to the road?
Section 10-64 bars any tent from being erected closer than 50 feet to a public right-of-way, and it cannot be positioned in a way that could create a traffic hazard. The area within and around the tent must also be cleared of underbrush, grass or other combustible material as a fire-protection measure.
