Mississippi Agricultural Zoning and Right to Farm

Mississippi's Right to Farm framework interacts with local zoning by recognizing that agricultural operations meeting accepted practices and existing for at least one year are shielded from being declared nuisances after surrounding land uses change. While counties and municipalities retain general zoning authority, Miss. Code Section 95-3-29 constrains the application of nuisance and zoning rules used to restrict ongoing farm activities. State law also protects farm-related practices such as forestry, animal husbandry, and crop production conducted on agricultural land. New ordinances cannot retroactively criminalize lawful farming, and pre-existing operations may continue under nonconforming-use principles even when zoning maps are amended.

Local zoning enforcement against protected farms can be challenged in court; unlawful or negligent operations remain subject to applicable rules.
