Mississippi Right to Farm Nuisance Protection Statute

Miss. Code Section 95-3-29 codifies Mississippi's Right to Farm protections, providing that no agricultural operation that has been in existence for one year or more becomes a private or public nuisance solely because of changed conditions in the surrounding non-agricultural area. The statute applies to operations following generally accepted agricultural practices and complying with federal, state, and local laws. It limits municipal nuisance ordinances and private suits brought by neighbors who move near a farm, reinforcing the policy that productive agricultural land should be conserved. The protection does not extend to operations conducted negligently or in violation of environmental, health, or zoning laws.

Operations conducted negligently, unlawfully, or beyond reasonable agricultural practices lose statutory immunity from nuisance liability.
