Gaithersburg requires a building permit for above-ground swimming pools with a water depth exceeding 24 inches, consistent with International Residential Code standards adopted by the city. Above-ground pools must meet the same 48-inch barrier requirements as in-ground pools. If the pool wall itself is at least 48 inches above grade and the access ladder or steps can be removed or locked, the pool wall may serve as part of the barrier on that side. However, any side of the pool accessible from a deck, patio, or elevated grade must have a separate fence or barrier with a self-closing, self-latching gate. Pools must be located in rear yards only and set back at least 5 feet from property lines in most residential zones. Installation over underground utility easements, septic systems, or stormwater facilities is prohibited. Electrical connections for pumps and filters require a separate electrical permit and must comply with NEC bonding and grounding requirements.
