Garfield treats above-ground pools the same as in-ground pools for placement: any permanently attached pool must sit at least six feet from rear and side lot lines under the city's accessory structure provisions.
Garfield's Zoning Chapter 341, Article IX explicitly applies to swimming pools 'whether below or above the ground.' Any pool permanently attached to the property must be set back at least six feet from any rear lot line and at least six feet from any side lot line of a contiguous lot. Above-ground pools are considered accessory structures and must also satisfy general accessory building rules and any applicable construction permit requirements under the New Jersey Uniform Construction Code. Removable kiddie or splash pools that are not permanently attached are not regulated by the setback rule but still must not create nuisances or drainage issues for neighbors.
Installing a permanent above-ground pool within six feet of a side or rear property line, treating an above-ground pool as exempt from accessory structure rules, or installing without required construction permits.
