Under N.J.S.A. 21:3-2 and the 2017 amendment, ground-based and handheld sparkling devices, snakes, and smoke devices are legal for adults 16+ in New Jersey. All aerial fireworks, including bottle rockets, firecrackers, Roman candles, mortars, and reloadable shells, remain illegal under N.J.S.A. 21:2 regardless of where they were purchased. Bergen County municipalities enforce the state ban, and police actively respond to fireworks complaints around July 4 and New Year's Eve. Public displays require a permit issued by the local fire official and the State Division of Fire Safety, with proof of insurance and use of a licensed pyrotechnician.
Possession or use of illegal fireworks is a disorderly persons offense punishable by up to six months in jail and fines up to $1,000.
