New Jersey law preempts fireworks regulation. In Fort Lee, only ground-based, hand-held sparklers and novelty items are legal for consumers, while aerial fireworks remain prohibited.
Under N.J.S.A. 21:3-3, New Jersey allows non-aerial, non-explosive fireworks such as ground-based sparklers, snake or glow worm pellets, smoke devices, and party poppers for residents 16 years or older. All consumer aerial fireworks including bottle rockets, firecrackers, and Roman candles remain illegal. Fort Lee Police and Fire enforce these restrictions especially around the Fourth of July. Display fireworks require a state permit and licensed operator.
Possession or use of illegal fireworks is a disorderly persons offense punishable by up to 6 months in jail and fines up to $1,000 under N.J.S.A. 21:2-7.
