Private swimming pools over 24 inches deep must be completely surrounded by a fence or barrier at least 48 inches high with self-closing, self-latching gates. NJ UCC standards apply. Fences in flood zones must meet additional requirements. Barrier must be installed before pool is filled.
Asbury Park requires all private swimming pools containing water more than 24 inches deep to be completely surrounded by a fence or barrier not less than 48 inches in height. Gates and doors must be self-closing and self-latching. The NJ Uniform Construction Code (N.J.A.C. 5:23) provides detailed specifications: vertical member spacing no more than 4 inches when horizontal rails are 45+ inches apart; chain-link mesh no more than 1.75 inches; latch mechanism at least 54 inches from ground. The barrier must be installed before the pool is filled. In flood hazard areas, pool fences must also comply with Chapter 24 floodway requirements β certain fence types (stockade, wire mesh) are prohibited in floodways. Building walls may serve as part of the barrier with compliant door alarms.
Pool without barrier: stop-work order, mandatory correction. Must drain pool until barrier installed and inspected.
