Florida's Residential Swimming Pool Safety Act (FS 515.29) sets the barrier standard used in Lake County: a barrier at least four feet high with no gaps a young child could crawl under, squeeze through, or climb over. Gates must open outward, be self-closing and self-latching.
Under FS 515.27, a new residential pool must have at least one approved safety feature, the most common being an isolating barrier meeting FS 515.29. The barrier must be at least 4 feet high on the outside, placed around the pool's perimeter, and set far enough from the water to prevent a child from immediately falling in. Gates must open outward away from the pool, be self-closing with a self-latching device, and have the release positioned out of a young child's reach. Lake County additionally requires that pools, spas and similar structures be completely enclosed with an approved wall/barrier, with setbacks measured from the deck or enclosure edge.
A pool cannot pass final inspection until the barrier requirements are met (FS 515.27). A person who fails to equip a pool as required commits a second-degree misdemeanor under FS 515.27(3); code enforcement can also cite non-compliant existing barriers.
