Fitchburg enforces Massachusetts state pool barrier rules. Any pool that can hold over 24 inches of water must be enclosed by a barrier at least 48 inches high, with self-closing/self-latching gates, per 780 CMR Appendix G (Massachusetts Building Code) and the State Sanitary Code 105 CMR 435. Fitchburg has not adopted a stand-alone pool barrier ordinance; instead the Building Department enforces 780 CMR Appendix G (the Massachusetts Swimming Pool and Spa Code, based on the 2015 ISPSC) for all residential and public pools deeper than 24 inches. Appendix G AG105 requires a barrier at least 48 inches above finished grade on the exterior side; a maximum 2-inch gap below the barrier; openings that will not pass a 4-inch sphere; and self-closing, self-latching gates with the latch at least 54 inches above grade (or shielded from outside access if lower). Hot tubs, spas, and above-ground pools follow the same rules unless equipped with an approved safety cover meeting ASTM F1346. Public and semi-public pools additionally fall under 105 CMR 435 (DPH State Sanitary Code Chapter V), administered locally by the Fitchburg Board of Health, which mandates fencing, depth markings, and lifeguard/operational standards. On the zoning side, Fitchburg Zoning Code Ch. 181 (eCode360) treats swimming pools as accessory uses: pools and uncovered decks must be set back at least 6 feet from any front, side, or rear lot line and may not encroach into the front yard setback. Fences in the front yard may not exceed 6 feet; stockade fences are capped at 6 feet, chain-link fences at 8 feet, with Board of Appeals special permits available for exceptions. A building permit and electrical permit are required before installation; the Building Commissioner inspects the barrier before the pool may be filled or used.
Operating a pool without a compliant barrier is a violation of 780 CMR and the Fitchburg zoning code. The Building Commissioner may issue a stop-use order, require draining of the pool, or impose fines up to $300 per offense under M.G.L. c. 40 Β§21D and Ch. 181. Each day of noncompliance is a separate violation. Public pools out of compliance with 105 CMR 435 may be closed by the Board of Health. Civil liability for injuries on an unfenced pool can fall on the homeowner under the attractive nuisance doctrine recognized in Massachusetts case law.
