Polk County pools follow Florida Statutes Chapter 515 (Residential Swimming Pool Safety Act) plus the Florida Building Code. The barrier must fully surround the pool, be at least 48 inches high measured on the outside, and be set back from the water's edge so a child who breaches it does not fall straight in. Gates must open away from the pool, be self-closing and self-latching, and the release mechanism must be on the pool side placed where a young child cannot reach it over the top or through gaps. Compliance is verified at inspection before final approval.
Failure to equip a residential pool with an approved barrier is a second-degree misdemeanor under FS 515.27, though penalties may be waived if corrected within 45 days plus drowning-prevention education.
