Unincorporated Volusia County follows Florida's strict pool barrier law (FL Β§515). Pool barriers must be at least 48 inches tall. Fence permits are still required when fences serve as pool safety barriers, even though the county removed general residential fence permit requirements.
FL Statute Β§515 (Residential Swimming Pool Safety Act) requires pool barriers for all residential pools and spas. Minimum 48-inch (4-foot) barriers with no climbable features. Gates must be self-closing and self-latching with latches at least 54 inches high or on the pool side. At least one additional safety feature required by FL law: pool alarm, safety cover, door alarm, or self-closing doors with alarms. The house wall can serve as part of the barrier with compliant door alarms. Floridaβs strict requirements reflect the stateβs high pool density and drowning prevention priority.
Non-compliant barriers: immediate correction order. Fines $250 to $1,000. Significant liability for drowning incidents. Real estate disclosure required.
