Florida Statute 515.29 sets the statewide residential pool barrier standard that Lee County enforces through the Florida Building Code. The barrier must be at least four feet high on the outside, contain no openings a young child could pass through, be placed around the pool perimeter (separate from the yard fence unless that fence meets the barrier standard), and stand far enough from the water's edge that a child who breaches it does not fall straight in. Gates must be self-closing and self-latching. This barrier is one of the safety options that lets a pool pass final inspection under FS 515.27.
Failure to provide a compliant barrier prevents a pool from passing final inspection. FS 515 makes non-compliance after notice a second-degree misdemeanor.
