New Castle County follows International Building Code (IBC) pool barrier standards as adopted. Pools must be enclosed by a barrier at least 48 inches (4 feet) high with no climbable footholds. Gates must be self-closing and self-latching with the latch on the pool side or at least 54 inches above grade. Pool fencing/barriers require a building permit from the Dept. of Land Use. The pool itself may also require a separate building permit.
Pools without proper fencing are code violations; use of the pool may be prohibited until barriers are installed.
