Florida Statute 515.29 sets the barrier standard used statewide, including unincorporated Manatee County. A qualifying barrier is at least 48 inches high, has no footholds or gaps that let a young child crawl under, squeeze through, or climb over, and sits away from the water's edge. Gates must open outward, be self-closing and self-latching, with the release on the pool side placed out of a child's reach. A fence barrier is one of several code options; a pool can alternatively use an approved safety cover, door/window exit alarms, or a pool alarm.
A pool failing to meet a barrier or alternative safety feature under FS 515.27 cannot pass final building inspection; noncompliance is enforced through the county building and code-enforcement process.
