Clay County, MO Swimming Pools & Spas: Fencing & Safety Requirements (2026)

Sec. 14 of the Rules and Regulations Relating to Swimming Pools, Spas and Similar Facilities in the County of Clay sets the barrier standard for every outdoor Category I pool (municipal or government-owned, open to the public) and Category II pool (hotels, motels, apartment complexes, athletic clubs, hospitals, HOAs, country clubs, schools and day cares) covered by Sec. 02's scope. Category III, meaning pools at single-family residential dwellings, is defined separately in Sec. 03(C) and sits outside this chapter's scope, so this fencing standard does not reach a private backyard pool directly.

For every covered pool, spa, hot-tub, whirlpool bath, sprayground or abandoned pool located outdoors, the enclosure (a fence, wall, building, or combination) must offer no external handholds or footholds, use material impenetrable by children under age three, stand at least four feet tall around the entire perimeter, keep the horizontal space between vertical members to four inches or less, and limit any gap under the bottom of the enclosure to two inches. Where the facility runs without a lifeguard on duty, every gate and door in the enclosure must carry a self-closing, positive self-latching mechanism mounted at least three feet up, plus a permanent locking device.

The Clay County Health Department enforces the chapter: Sec. 15 gives the health director authority to inspect a pool at any reasonable time and to close it in writing when conditions, including a noncompliant enclosure, create a hazard. Sec. 16 makes clear that where a municipal, state or federal rule is more restrictive than this chapter, the stricter provision controls.
