Every residential pool, spa, or hot tub in Venice must have at least one of four safety features under Fla. Stat. 515.27: a 48-inch perimeter barrier with self-closing/latching gates, an approved safety cover, exit alarms on every door/window, or self-closing/latching devices on doors with release at least 54 inches from the floor.
Compliance is verified at building-permit final inspection under Ch. 88 and again any time Code Enforcement responds to a complaint. The barrier must have no openings or surfaces that allow climbing. Gates must open outward, away from the pool, and be self-closing and self-latching with the latch handle at least 54 inches above the ground (or other location not readily accessible to a child under 5). Failing any single requirement violates the Act.
Non-compliance is a second-degree misdemeanor under Fla. Stat. 515.29 punishable by up to 60 days jail and $500 fine, plus mandatory pool-safety education. Additional civil fines apply under Code Enforcement Board orders.
