Spas and hot tubs are treated like pools and generally need a 48-inch barrier. A spa or hot tub is exempt from the barrier ordinance only if it has a solid lockable safety cover meeting ASTM F1346-91. Swimming pools with safety covers do NOT get that exemption in McHenry County.
McHenry County § 8.04.100 applies to in-ground, above-ground and on-ground pools, spas and hot tubs. The one carve-out is a spa/hot tub protected by a listed ASTM F1346-91 safety cover, which substitutes for the fence. A hot tub still requires the appropriate building/electrical permit, and municipalities such as Crystal Lake apply equivalent barrier or safety-cover rules within their limits.
An uncovered spa or hot tub without a 48-inch barrier is a barrier-ordinance violation. The County may abate it as a public-health nuisance; the ASTM-cover exemption only applies while the compliant cover is in place.
