McHenry County § 8.04.100(B)(11) requires all gates to meet the same spacing rules as the fence and to accept a locking device. For public and semi-public pools, Illinois IDPH rules (77 Ill. Adm. Code 820.200) separately require a self-closing, self-latching gate on a barrier at least four feet high. These rules exist to keep young children from reaching the water unsupervised.
A propped-open, missing or non-latching gate defeats the barrier and is treated as a pool with no barrier: the County may bar the pool from use, and cities issue building-code citations with per-day penalties.
