Spas and hot tubs are regulated by the Tulare County Resource Management Agency under the adopted California Building Standards Codes. A spa typically requires electrical and plumbing permits at minimum, and a building permit depending on size, construction type, and whether it is built in-ground or as a self-contained unit. Where a building permit is issued for a new or remodeled spa at a single-family home, the California Swimming Pool Safety Act (HSC 115922) applies, requiring at least two of seven drowning-prevention features and, for new construction, anti-entrapment suction outlets under HSC 115928. State law does, however, distinguish self-contained spas: a self-contained spa or hot tub equipped with a listed safety cover that complies with the ASTM F1346 standard is treated differently from a pool for barrier purposes — the locking, listed cover serves as the safety measure. The County does not publish a separate spa ordinance for the unincorporated area; it relies on these adopted state codes. Owners should also confirm electrical bonding/grounding of spa equipment and zoning setbacks for placement under the County zoning regulations.
