New York State Residential Code requires all residential pools capable of holding water more than 24 inches deep to have: a compliant barrier enclosure (48-inch minimum height fence), a pool alarm meeting ASTM F2208 (except pools with automatic power safety covers), GFCI-protected electrical receptacles supplying pool equipment located at least 6 feet from the inside pool wall, proper bonding and grounding, and a temporary barrier during construction replaced with a permanent barrier within 90 days. Building permits are required from the local municipality for all pools over 24 inches deep. Final inspections are required before pool use. Monroe County Department of Environmental Health issues permits for and inspects commercial/semi-public swimming pools under NYS Sanitary Code Subparts 6-1, 6-2, and 6-3. Residential pool operators should contact their specific town building department.
