Summary
San Luis Obispo County charges a separate business license fee for each distinct type of business a person operates in the unincorporated area. Under Code Section 6.00.040, a single combined license at one location costs only the highest single fee that would apply, but separate licenses cost the full fee for each business type.
6.00.040 - Separate activities. If a person engages in, conducts, manages, advertises, or carries on at the same time more than one of the natures of business regulated by this title, while engaging in, conducting, managing, or carrying on each such nature of business separately and apart from the others, the annual fees charged shall be as follows: (1) If the applicant requests a single license to be displayed at a single location, the total fee for all natures covered by the single license issued at the same time and to the same person, at any one location shall be equal to the fee for that nature of business requiring the highest license fee. (2) If the applicant requests separate licenses for each nature of business conducted, even if each business is conducted or carried on at the same location by the same person, each nature of business that has a separately issued license shall be charged the full annual fee for that nature of business.
Full Breakdown
020 makes operating without the required license a misdemeanor, with each unlicensed day a separate offense. 040 addresses a person running more than one type of licensed business at the same time and location: if the operator requests a single license covering every business nature at one location, the total annual fee equals only the fee for whichever nature of business carries the highest license fee, not the sum of all of them. If the operator instead requests separate licenses for each business nature, even at the same location under the same owner, each separately licensed business pays the full annual fee for its own classification.
060 requires the license be issued in the licensee's true name, or a properly filed fictitious business name, with corporate licenses naming the exact entity on file with the state.
Violations & Fines
Operating a business, exhibition, occupation or other licensed activity without first procuring the required license and paying its fee is a misdemeanor under Section 6.00.020, and Section 6.00.080 sets the general penalty for violating Title 6 at a fine or imprisonment up to the limits set by California Government Code Section 25132. Each day the activity continues without a license, or under a false or fictitious business name, counts as a separate offense subject to its own penalty.
