Full Breakdown
New York State bans retail sale of most flavored liquid nicotine under Public Health Law § 1399-mm-1, but Suffolk County goes further. County Code § 792-9C makes it illegal for any retail liquid nicotine business or retail tobacco business to intentionally receive or store banned flavored e-liquid anywhere on the premises, or to sell, distribute, or ship it to any other business within the county, even if it's never offered for retail sale there. The Department of Health Services enforces it, and intentional violations of § 792-9 are unclassified misdemeanors under § 792-10.
Violations & Fines
Unclassified misdemeanor: up to $1,000 fine for a first violation, up to $2,000 for each subsequent violation; each incident is a separate offense.
