New York banned the sale of flavored vapor products under Public Health Law Section 1399-mm-1 in 2020, prohibiting flavors other than tobacco from being sold by retailers, manufacturers, and online sellers shipping into New York. Suffolk County retailers may not stock or sell mint, fruit, dessert, or candy flavored vape liquids, pods, or disposables. Menthol cigarettes are not banned by New York at the state level. The federal FDA has proposed a menthol cigarette ban that, if finalized, would apply nationwide. SCDHS and NY DOH conduct retail compliance checks. Suffolk County also has local code restricting flavored tobacco product placement and marketing near schools.
Selling flavored vape products, mislabeled tobacco-flavored items, or violating placement and marketing restrictions can result in state PHL penalties and Suffolk County retailer license consequences.
