(a)Occupants of single-family dwelling units, condominiums or multi-family dwelling units not served by a common commercial container shall place refuse receptacles, rubbish and bundles on assigned collection days, at roadside locations in such a manner as not to obstruct traffic or block sight distance of motorists. Occupants shall place such refuse at appropriate locations prior to the arrival of the collection vehicles. This placement shall not be made before noon on the day prior to collection day.(b)Occupants shall remove containers from such locations to storage locations, which shall be nearer to the residential unit located on the premises than to any street abutting the premises; removal should be accomplished within a reasonable time following collection on the day the contents are emptied and collected.(d)All trash and refuse will be collected by the licensee if placed in receptacles. Full Breakdown
Sec. 62-42, adopted by Ord. No. 023-24 (12-17-24), sets the placement rules that residential haulers and occupants must follow. Refuse receptacles, rubbish, and bundles go out at roadside locations only on the assigned collection day, in a manner that doesn't obstruct traffic or block a motorist's sight distance, and placement cannot happen before noon on the day prior to collection. After the truck empties the contents, occupants must move the containers back to a storage spot on the property that sits nearer the residence than to any abutting street, within a reasonable time.
Solid waste generated by an allowed home occupation is billed at the residential rate rather than commercial. Containers themselves must be actual receptacles; open containers and untied plastic bags are barred, so a licensee has no obligation to collect loose bags. During any week containing a legal holiday or extreme weather such as snow or ice, licensees must still collect residential waste at least once. The section also requires the environmental management division to keep a public list of current licensees available for inspection, and it reserves to the county the right to restrict and control the time, place, and manner of residential solid waste handling and disposal at any point.
Violations & Fines
Setting refuse out before noon the day before collection, placing receptacles so they obstruct traffic or block sight distance, leaving empty containers at the curb instead of moving them to storage after pickup, or using open containers or untied plastic bags all violate Sec. 62-42. A licensee that skips the guaranteed holiday or severe-weather collection under subsection (e) breaches the terms of its county license, and the county reserves authority under subsection (h) to further restrict placement practices.
