Full Breakdown

McHenry County's Solid Waste and Recycling Ordinance places responsibility for how a garbage or recycling cart sits before pickup squarely on the resident. 040(A), until a licensed hauler removes the materials, the occupant who sets them out is fully responsible for their proper preparation, handling and storage, and ownership only shifts to the hauler once the cart is actually collected. 040(B) adds that if a cart is skipped because it visibly contains recyclable material mixed with trash, the occupant, not the hauler, must re-sort it in line with the county's Residential Recycling Ordinance rather than leave it at the curb.

030(A), which requires every occupant with mandated recyclable materials, aluminum and steel cans, newsprint, cardboard, plastics, and glass, to separate them from regular trash and store them in dedicated recycling containers rather than a single mixed cart. , a floor that indirectly sets how early a resident's cart can legally be picked up. 090(E) from removing a bag or container that visibly displays a warning sticker showing it holds mandated recyclables, so a resident who tags a contaminated cart can expect it left at the curb rather than hauled away.

Violations & Fines

Any violation of the County's Solid Waste and Recycling Ordinance, including an occupant's failure to properly store or segregate materials under Section 8.24.040 or 8.44.030(A), is punishable under Section 8.24.130(A) by a fine of no less than $100 and no more than $500, with each observed violation treated as a separate offense. The Solid Waste Department can also issue a Notice of Violation with a compliance deadline before escalating to a Notice to Appear.

Frequently Asked Questions

Who is responsible for my garbage cart before pickup?
You are. Section 8.24.040(A) makes the occupant who sets out the materials fully responsible for their preparation, handling and storage until the licensed hauler actually removes them; ownership and responsibility only shift to the hauler at the moment of collection.
How early can my hauler start collection?
Not before 5:00 a.m. Section 8.24.090(F) bars any licensed municipal waste hauler serving unincorporated McHenry County from beginning collection activities earlier than 5:00 a.m., whether the resident subscribes to flat-rate, pay-as-you-throw, or volume-based pricing.
What if my hauler skips my cart?
If your cart is left because it visibly contains recyclables mixed with trash, Section 8.24.040(B) requires you to re-sort the material yourself in line with the county's Residential Recycling Ordinance; haulers are barred from removing a bag that displays a contamination warning sticker under Section 8.24.090(E).
What's the fine for a solid waste ordinance violation?
Section 8.24.130(A) sets a fine of at least $100 and at most $500 per violation, with each observed instance counted as a separate and distinct offense, and the County can also deny or suspend a hauler's license for repeated noncompliance.
