Summary

Marion County runs no municipal trash truck: every residential owner must independently haul waste, hire a franchise hauler, or otherwise lawfully dispose of it.

These county ordinances apply to unincorporated areas of Marion County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Any person that owns residential property shall be responsible for the lawful disposal of any solid waste generated on their residential property. Upon request, such person shall demonstrate to the director that the person: (a) hauls their solid waste to a county solid waste management facility; (b) uses the residential collection service provided by a franchise holder; or (c) otherwise lawfully disposes of the solid waste generated on their residential property.

Under Sec. 16-61, residential property owners bear personal responsibility for lawful disposal of their solid waste. There is no county-operated collection route or fixed citywide pickup day. Owners must either haul waste to a county facility themselves, sign up with a private franchise hauler licensed under Chapter 16, or otherwise dispose of it lawfully. On request, the solid waste director can require proof of compliance. Residents using a franchise hauler set their own pickup day and frequency by contract with that hauler (Sec. 16-26), but haulers may only run residential routes 5:30 a.m.-7:00 p.m., Monday through Friday (Sec. 16-35).
