The size of the commercial container and the frequency of collection shall be determined by the customer and the franchisee except as specified herein. However, size of container and frequency of pick-up shall ensure that no garbage or solid waste will be placed outside the commercial container or receptacle at any time.

Section 25-1938(2) sets the frequency floor for commercial dumpster service: ordinary business accounts get at least one solid-waste pickup weekly (horticulture waste excluded), multifamily buildings run as commercial accounts (apartments, condos, mobile home parks) get one solid-waste plus one recycling pickup weekly, and food-processing or food-service businesses need at least two pickups a week. Multifamily properties using a roll-off compactor may get a reduced schedule if the Solid Waste Division approves it. Container size and pickup frequency beyond the weekly floor are negotiated between the customer and the County's franchised hauler, but the code requires the combination to be sufficient that lids close and nothing sits outside the container between pickups; a customer generating a cubic yard or less per week may use a standard receptacle instead of a dumpster.
Customers can source their own commercial container from any vendor, but they are fully responsible for its maintenance and it must be a type the franchisee's trucks can service. Section 25-1939 separately requires new construction, both commercial buildings and multifamily developments, to designate on-site space for garbage and recycling containers before a building permit issues: 120 square feet for garbage and 96 for recyclables for a 5-25 unit multifamily project or a building up to 5,000 square feet, scaling to 216 square feet combined for the first 25 units or 25,000 square feet plus incremental square footage beyond that.
Any project using a compactor must add space for the compactor and receiver on top of the recycling space. The pad must also allow a minimum 22-foot overhead clearance and a 12-foot-wide opening so collection trucks and personnel are not blocked.
Violations & Fines
Violations of the collection division are enforced concurrently by the Solid Waste Division, Codes and Building Services, and the Sheriff's Office under § 25-1942, through the hearing-examiner or citation process. A property owner or tenant found in violation faces a civil fine of up to $500.00 per violation, with each day of continued noncompliance counted as a separate violation; criminal violations are punished under the general penalty in § 1-7. If the County has to abate a dumpster-related public nuisance itself, it bills the property owner and can place a lien for unpaid invoices plus interest.
