Summary
Harford County Code § 109-3C requires the size, type and number of trash containers at commercial facilities to be set case by case, and every dumpster, compactor or dump-type unit used by a business must be approved by the Harford County Health Department before it goes into service.
C. Commercial facilities. (1) The container size, type and number shall be determined on an individual basis for commercial facilities. In those facilities generating mixed trash and garbage and using a dump-type container, the contractor shall be responsible for the removal and replacement of these units with a clean container when he is notified by an inspector of the Health Department that the in-place unit is in need of cleaning or repair. (2) All commercial enterprises, such as retail stores, restaurants, diners, quick food shops, apartment complexes and multiple-family units, will be serviced by a dump-type container, compactor or similar-type unit. All units of this type that are in use or that may be proposed for use within the county shall be subject to the approval of the Health Department. These units may also be required for use in such other areas as directed by the Health Department.

Full Breakdown
Under § 109-3C of the Harford County Code, retail stores, restaurants, diners, quick food shops, apartment complexes and multiple-family developments are required to use a dump-type container, compactor or similar unit, with the Health Department approving the specific size, type and number for each site rather than applying one county-wide standard. The Health Department can also require these container types in other locations at its discretion. When a facility generates mixed trash and garbage using a dump-type container, the hauling contractor is responsible for pulling and replacing the unit with a clean container once a Health Department inspector notifies the contractor that the in-place dumpster needs cleaning or repair; owners cannot leave a stained or overflowing dumpster in place and blame the hauler once that notice is given.
Separately, the Zoning Code addresses dumpster screening for one specific project type: § 267-77C(5) requires trash containers and dumpsters at planned employment centers in the Edgewood Neighborhood Overlay District to be buffered on all sides exposed to street view, with buffer materials matching the main building's color and texture, administered through the site plan process and § 267-30's buffer yard standards. That screening duty applies only within that overlay's planned employment center projects, not to commercial dumpsters generally. Enforcement of § 109-3 runs through Chapter 109's Article I enforcement mechanism at § 109-16: the Health Department or the Department of Public Works can issue a notice of violation and a corrective order, with a hearing right if requested within ten days of service.
Violations & Fines
A commercial dumpster placed, used or maintained without Health Department approval, or left unswapped after an inspector's cleaning notice, exposes the business to a civil penalty of up to $1,000 per day per violation under § 109-16C, collectible in a civil action. Criminal enforcement under § 109-16E treats the same conduct as a misdemeanor punishable by a fine of up to $1,000 per day or up to six months' imprisonment, or both, with each day and each violated provision counted separately.
