Summary

Ulster County makes it a misdemeanor to dump refuse from outside the County into any refuse disposal area within it. Section 304-3 bans depositing out-of-County garbage, industrial waste, construction debris or dredge material in a County disposal site, and § 304-5 punishes a violation with up to $2,000 in fines, six months in jail, or both, plus possible injunctive action by the County Attorney.

These county ordinances apply to unincorporated areas of Ulster County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

§ 304-3. Refuse from outside County. No refuse originating as such outside the County of Ulster, or which has been collected or otherwise obtained outside the County of Ulster and transported or otherwise delivered within said County, shall be deposited, or caused or allowed to be deposited, in any refuse disposal area within the County of Ulster. ... § 304-5. Penalties for offenses. A. Each violation of, or nonconformance with, any provision of this article shall constitute a misdemeanor punishable by a fine of not more than $2,000 or by imprisonment for not more than six months, or by such fine and imprisonment. B. The County Attorney of Ulster County is authorized to commence an action in any court of competent jurisdiction to enjoin any violation of this article.

Full Breakdown

Adopted to protect the County's limited landfill capacity, Article I of the Solid Waste chapter, codified at §§ 304-1 through 304-5, finds that 'existing refuse disposal sites within the County are becoming seriously depleted' and that this depletion 'results in a significant hazard to the health, safety and welfare of the residents of the County' (§ 304-1). ' 'Refuse' is defined broadly at § 304-2 to include regulated waste, construction and demolition debris, garbage, industrial waste and dredge material, meaning haulers cannot bring outside construction debris, demolition material, or sediment dredged from the Hudson River or elsewhere into a County disposal site any more than they can bring ordinary household garbage.

Section 304-4 grandfathers disposal sites already lawfully operating on the law's effective date, but even a grandfathered site violates the article if it takes in more than 60 tons per calendar week of out-of-County refuse or exceeds the area covered by its existing New York State Department of Environmental Conservation operating permit. Enforcement runs through § 304-5: any violation of the article is a misdemeanor, carrying a fine of up to $2,000, imprisonment of up to six months, or both, and the County Attorney is separately authorized to sue in any court of competent jurisdiction to enjoin the violation, meaning the County can go to court to stop illegal dumping without waiting on a criminal case.

Violations & Fines

Depositing out-of-County refuse, including garbage, construction and demolition debris, industrial waste or dredge material, in an Ulster County disposal site violates § 304-3 and is a misdemeanor under § 304-5, punishable by a fine of up to $2,000, up to six months in jail, or both. The Ulster County Attorney can also sue separately to enjoin the dumping in any court of competent jurisdiction.

Frequently Asked Questions

Is it illegal to dump trash from another county in Ulster County?
Yes. Section 304-3 bars depositing refuse that originated, or was collected, outside Ulster County into any refuse disposal area inside the County, and a violation is a misdemeanor under § 304-5.
What counts as 'refuse' under this law?
Section 304-2 defines refuse broadly to include regulated waste, construction and demolition debris, garbage, industrial waste and dredge material such as sediment removed from the Hudson River, so the out-of-County ban covers more than household garbage.
What is the penalty for illegal dumping in Ulster County?
A violation of § 304-3 is a misdemeanor under § 304-5, punishable by a fine of up to $2,000, imprisonment of up to six months, or both, and the County Attorney can separately sue to enjoin the dumping.
Are any existing disposal sites exempt from this rule?
Sites lawfully operating before the law's effective date are grandfathered under § 304-4, but even those sites violate the article if they take in more than 60 tons of out-of-County refuse per calendar week or exceed their DEC-permitted area.
