050 defines the littering offense broadly: discarding litter on a public place, discarding it on private property without the owner's consent, discarding it on a public roadway, driving or moving a vehicle in a way that deposits litter on a roadway, or letting an animal in one's custody excrete litter on public or private property. Two affirmative defenses exist: disposing litter in a County-designated collection spot, or discarding on private property with the owner's consent. 030 gives enforcement officers power to issue a written citation on witnessed violations or probable cause, investigate discarded litter for identifying evidence, and tow away an offending vehicle at its owner's expense; a reported vehicle license plate number is treated as prima facie evidence the registered owner did the littering.
