§ 4-03-1140. ACCUMULATION OF SOLID WASTE TO BE REMOVED. Whenever any Solid Waste has been thrown or deposited upon any street, road, or private or public premises, or has accumulated thereon, the Public Health Officer shall give written notice to the owner, tenant or person having charge or control of said premises, to remove from the premises the substances so deposited or accumulated. It shall be unlawful for the owner, tenant or person having charge or control of said premises to neglect or fail to remove said Solid Waste from said premises within five (5) days after the receipt of said notice.

Full Breakdown

Ordinance Code § 4-03-1130 makes it unlawful to maintain or use any residence, business or occupied building without sanitary means of solid waste disposal, requiring a fly-tight garbage pit or fly-tight, waterproof, covered cans emptied weekly; cans must be pulled off the street within 24 hours of emptying and may never sit in a County or other public right-of-way. Section 4-03-1140 separately targets dumped or accumulated waste: whenever solid waste "has been thrown or deposited upon any street, road, or private or public premises, or has accumulated thereon," the Public Health Officer gives the owner, tenant or person in control written notice to remove it, and it is unlawful to neglect or fail to remove the material within five days after receiving that notice.

Section 4-03-1131 separately bars depositing tires or Bulk Waste in a solid waste container without the Solid Waste Collector's prior consent. These storage-and-disposal prohibitions sit in Article 3 of Chapter 4-03, enacted by Ordinance No. 3596, effective December 7, 2021, and are enforced by the Solid Waste Director, Public Health Officer and Solid Waste Department under § 4-03-1080's inspection authority.

Violations & Fines

Violating §§ 4-03-1130, 4-03-1131 or 4-03-1140 is an infraction under § 4-03-1400(b), each day of the violation counted as a separate offense. Ordinance Code § 125(a) sets infraction fines at up to $100 for a first conviction, $200 for a second within a year and $500 for a third or later conviction within that year; separately, violating the disposal-facility approval standard in § 4-03-1135 is a misdemeanor under § 4-03-1400(a), punishable under § 125(b) by up to a $1,000 fine, six months in County jail, or both.

Frequently Asked Questions

What happens if I dump trash on a vacant lot or the roadside in unincorporated Tulare County?
Under § 4-03-1140 the Public Health Officer sends written notice to the property owner or person in control ordering removal, and failing to clear it within five days is a separate infraction under § 4-03-1400(b), punishable up to $500 for repeat convictions under § 125(a).
Can I leave my garbage cans at the curb after collection?
No. Section 4-03-1130 requires cans to be removed from the street within 24 hours after being emptied and bars leaving them in the County right-of-way at any time.
Does this illegal dumping rule apply inside Visalia or the City of Tulare?
No. This Ordinance Code chapter governs only unincorporated Tulare County; dumping inside Visalia, Tulare, Porterville or Dinuba is enforced under that city's own municipal code.
