(a)All collectors must offer to their residential customers the service of having their recyclable materials collected on a regular basis each month and must provide recycling service to their customers enrolled in the recycling program. Recyclable materials to be collected shall include at a minimum the following items: cardboard, PET, HDPE and hard-to-recycle plastics (currently under the Hefty ReNew program material which is subject to change), newspaper and aluminum.(b)All collectors must provide an appropriate container or other type of receptacle for those residential customers opting for this recycling service. Any and all collectors providing such containers to their residential customer may charge a fee for said containers.(c)In no event shall any of the recyclable materials collected pursuant to this optional recycling service be disposed of in any landfill with the intent to circumvent the proper recycling material flow... (d)Any failure to comply with or violation of the provisions contained in this section shall subject the offender to penalties as specified in section 102-14 and applicable federal, state and local law.

Under subsection (b), a collector must furnish an appropriate container or receptacle to any customer who opts into the service, and may charge a fee for that container.
Subsection (c) bars collectors from routing recyclables collected under this program to a landfill in order to circumvent the proper recycling material flow, though an exemption applies if material is later rejected as contaminated by the material recovery facility after curbside pickup separate from municipal solid waste. Collectors are also barred from dropping recyclables collected under this section at a Cobb County Residential Drop-Off Center. Subsection (d) ties enforcement to Section 102-14, which lets the sustainability, waste and beautification department cite offenders to magistrate court.
Violations & Fines
A collector who fails to offer or provide the recycling service, misuses collected recyclables, or dumps them to circumvent the program commits a misdemeanor under Section 102-14: up to a $1,000 fine and up to 60 days in jail per violation, after citation and conviction in magistrate court. A second violation within 12 months adds $200 to the fine, capped at $1,000; a third adds $650; a fourth or later draws the full $1,000 fine outright. Repeat or uncorrected violations can also trigger permit suspension under Section 102-58.
