In addition, within two hundred seventy (270) days of the effective date of this ordinance, the occupants of residential dwelling units located in the County shall also be required to separate for collection and composting yard waste, from March through December and for Christmas trees during the first two weeks of January. Residents shall be prohibited from combining these recyclable or compostable materials with other solid waste. ... (h)No person shall engage in the business of collecting recyclable materials in county as a commercial enterprise without registering the recycling business with the county in accordance with the solid waste regulations and shall also be subject to the reporting requirements included under Sec. 22-169 (Nonresidential and refuse removal reporting).

Subsection (h) requires anyone running a commercial recyclable-collection business in the county to register with the county and comply with the reporting duties of Sec. 22-169, though employees, nonprofit fundraisers and residents transporting their own material are exempt. The Director of Public Works, with the County Executive's approval, can add or delete which materials are covered.

Sec. 22-171 only triggers penalties if the Department of Public Works finds the county missed its recycling goals in a completed fiscal year and publishes that finding for two straight weeks in a local newspaper.
